自带酒水去酒楼，然后对老板收取“开瓶费”的要求说“NO”？不行！至少法律上行不通。

备受关注的北京首例“开瓶费”终审判决如下：酒店退还消费者“100元开瓶费”，但判决的理由是酒楼没有收费“明示”。这将意味着，有收费“明示”的酒店可以向消费者合法索要“开瓶费”。
