上海市停车场(库)管理办法

第一章 总则

第一条 (目的和依据)

为了加强本市停车场(库)的规划、建设和管理,满足停车需求,改善交通状况,保障停车场(库)经营者和停车者的合法权益,根据有关法律、法规的规定,制定本办法。

第二条 (适用范围)

本办法适用于本市行政区域内停车场(库)的规划、建设、使用及其相关管理活动。

本办法所称的停车场(库)包括公共停车场(库)、道路停车场和专用停车场(库)。

第三条 (管理部门)

上海市城市交通管理局(以下称市交通行政主管部门)是本市停车场(库)的主管部门,负责本办法的组织实施。区(县)交通行政主管部门按照规定的职责,负责本行政区域内停车场(库)的管理工作。

上海市陆上运输管理处和区(县)陆上运输管理所(署)(以下统称陆上运输管理机构)按照规定职责,负责本行政区域内停车场(库)的日常管理工作。

本市规划、建设、市政工程、公安交通、房地资源、财政、价格等管理部门按照各自职责,协同实施本办法。

第四条 (行业协会)

本市停车服务行业协会应当按照法律、法规规定,发挥行业自律作用,并可以接受市交通行政主管部门的委托,协助做好本市公共停车场(库)的管理工作。

第五条 (鼓励和推广)

本市鼓励多元化投资建设公共停车场(库),鼓励专用停车场(库)向社会开放,推广应用智能化、信息化手段管理公共停车场(库)和道路停车场。

第二章 停车场(库)规划与建设管理

第六条 (规划编制)

公共停车场(库)专业系统规划由市交通行政主管部门根据城市规划布局结构和交通需求状况,会同市公安交通管理部门编制,经市规划行政管理部门综合平衡并报市政府审批后,纳入全市总体规划。

区(县)政府在编制控制性详细规划时,应当与公共停车场(库)专业系统规划相衔接。市规划行政管理部门在审批控制性详细规划时,应当征求市交通行政主管部门的意见。

第七条 (用地控制)

公共停车场(库)专业系统规划确定的停车场(库)用地属道路广场用地,未经法定程序调整,不得改变用途。

第八条 (设置标准和设计规范)

公共停车场(库)和专用停车场(库)的设计方案,应当符合国家和本市停车场(库)的设置标准和设计规范。

本市停车场(库)设置标准和设计规范,由市交通行政主管部门会同市公安交通管理部门、市规划行政管理部门编制,经市建设行政管理部门批准后实施。

第九条 (配套建设)

新建公共建筑和居住区应当按照国家和本市停车场(库)的设置标准和设计规范,配套建设停车场(库)。

配套建设的停车场(库)应当与主体工程同步设计、同步施工、同步交付使用。

第十条 (补建)

下列公共建筑未按国家和本市停车场(库)的设置标准和设计规范配套建设停车场(库)的,应当在改建、扩建时补建:

(一)火车站、客运码头、机场、省际道路客运站以及公共交通与自用车辆换乘的枢纽站;

(二)体育(场)馆、影(剧)院、图书馆、医院、会展场所、旅游景点、商务办公楼以及对外承办行政事务的办公场所;

(三)建筑面积在5000平方米以上的商场、旅馆、餐饮、娱乐等经营性场所。

前款规定的公共建筑因客观环境条件限制,无法补建停车场(库)的,公共建筑所有人应当向市、区(县)规划行政管理部门提交有关专家技术论证报告。

第十一条 (建设审查)

本市各有关部门应当按照国家和本市建设项目审批管理的有关规定,对公共停车场(库)的建设进行审查。

市、区(县)规划行政管理部门和建设行政管理部门在审查公共停车场(库)建设工程的规划方案和初步设计方案时,应当征求市、区(县)交通行政主管部门和公安交通管理部门的意见。

第十二条 (竣工验收)

市、区(县)规划行政管理部门对公共停车场(库)建设工程进行规划验收时,应当通知市、区(县)交通行政主管部门参加。

第三章 公共停车场(库)经营管理

第十三条 (经营登记备案)

公共停车场(库)经营者应当依法办理工商、税务登记手续,并在工商登记后15日内,持有关材料向陆上运输管理机构办理备案手续。

公共停车场(库)经营者变更登记事项或者歇业的,应当按规定向工商、税务部门办理相关手续,并自变更、歇业之日起15日内向陆上运输管理机构办理备案手续,同时向社会公告。

第十四条 (改变使用性质的审核)

任何单位和个人不得擅自将已建成的公共停车场(库)挪作他用。

改变公共停车场(库)使用性质的,应当经市、区(县)规划行政管理部门会同市、区(县)交通行政主管部门和公安交通管理部门批准。

第十五条 (停放车辆服务规范)

公共停车场(库)经营者应当遵守下列服务规范:

(一)设置醒目、统一的停车场(库)标志牌和市交通行政主管部门制定的停放车辆规则,公布监督电话;

(二)制定停放车辆、安全保卫、消防等管理制度;

(三)配置完备的照明设备、通讯设备、计时收费设备;

(四)指挥车辆按序进出和停放,维护停车秩序,确保停车设施的正常运行;

(五)执行停车收费规定,在醒目位置明码标价;

(六)工作人员佩戴服务牌证。

第十六条 (驾驶员行为规范)

机动车驾驶员及其随车人员在公共停车场(库)停放车辆应当遵守下列规定:

(一)服从工作人员的指挥,有序停放车辆;

(二)不得损坏停车设施、设备;

(三)不得停放装有易燃、易爆、有毒、有害等危险物品或者其他违禁物品的车辆。

第四章 道路停车场管理

第十七条 (设置原则和方案)

道路停车场的设置应当严格实行总量控制。

道路停车场的设置方案由市公安交通管理部门会同市市政工程管理部门、市交通行政主管部门按照下列原则编制:

(一)符合区域道路停车总量控制要求;

(二)与区域停放车辆供求状况、车辆通行条件和道路承载能力相适应;

(三)区别不同时段、不同用途的停车需求。

在本市外环线以内的公共停车场(库)300米服务半径内设立道路停车场的,市公安交通管理部门应当会同市交通行政主管部门举行听证。

第十八条 (管理者的确定)

道路停车场管理者确定的办法,由市交通行政主管部门另行制定。

第十九条 (计费方式)

道路停车可以采取按时或者按次方式计收停车费。

道路停车采取按时计费的,可以根据周边地区的道路交通状况,采取累进计费或者限时停车的办法计费。

第二十条 (收费方法)

道路停车场管理者可以采用电子仪表方法或者人工方法,收取停车费。

第二十一条 (收费管理)

道路停车场收费属行政事业性收费,实行收支两条线管理。收入全额上缴财政,支出由财政按批准的预算核拨。

第二十二条 (撤除)

道路停车场有下列情形之一的,市交通行政主管部门经征求市公安交通管理部门意见后,应当及时予以撤除,并通知市市政工程管理部门:

(一)道路交通状况发生变化,道路停车已影响车辆正常通行;

(二)道路周边的公共停车场(库)已能满足停车需求。

道路停车场撤除后,道路停车场管理者应当及时恢复道路设施原状。

第二十三条 (道路停车服务规范)

道路停车场管理者应当遵守本办法第十五条第(一)、(五)、(六)项规定以及下列服务规范:

(一)在道路停车场划设明显的车位标志,配备必要的照明设施;

(二)不得擅自扩大占路面积;

(三)采用电子仪表收费方法的,在醒目位置明示电子仪表收费设施的使用说明,并加强对设施的维护保养,确保设施整洁、完好。

第二十四条 (道路停车行为规范)

机动车驾驶员在道路停车场停放车辆,应当遵守下列规定:

(一)本办法第十六条的规定;

(二)按照规定支付停车费;

(三)在限时停车的道路停车场不得超时停车。

机动车驾驶员在采用电子仪表收费方法的道路停车场停放车辆的,应当将交费凭据放置在车辆前挡风玻璃内的明显位置,以备查验。

第五章 其他相关管理

第二十五条 (收费价格管理)

本市停车场(库)服务收费根据不同性质、不同类型,分别实行市场调节价、政府指导价、政府定价。

实行政府指导价、政府定价的停车场(库),应当区别不同区域、不同停车时间,并按照同一区域道路停车高于路外停车的原则,确定停车收费标准。

实行政府指导价、政府定价的停车收费标准,由市价格行政主管部门会同市财政部门、市交通行政主管部门另行制定。

第二十六条 (票据管理)

公共停车场(库)经营者收取停车费,应当使用由市地方税务部门监制的统一发票。

道路停车场管理者收取停车费,应当使用由市财政部门监制的专用收费票据。

公共停车场(库)经营者或者道路停车场管理者不按规定开具统一发票、收费票据的,停车者可以拒付停车费。

第二十七条 (信息化管理)

本市实行公共停车信息系统联网管理。

上海市陆上运输管理处应当组织公共停车信息系统的建设,推广应用智能化、信息化手段管理公共停车场(库)和道路停车场,并负责公共停车信息系统运行的监督管理。

公共停车场(库)经营者和道路停车场管理者应当按照有关规定和标准,将其停车信息纳入全市公共停车信息系统。

公共停车信息系统的联网管理规定和有关标准,由市交通行政主管部门会同有关部门制定。

第二十八条 (统计)

公共停车场(库)经营者和道路停车场管理者应当按照规定,向陆上运输管理机构如实报送统计资料。

专用停车场(库)的所有人或者其委托的管理人应当按照规定申报停车场(库)的泊位数。

申报专用停车场(库)泊位数的办法,由市交通行政主管部门会同市房地资源管理部门另行制定。

第二十九条 (专用停车场的调用和开放)

本市举行重大活动期间,公共停车场(库)不能满足社会停车需求时,专用停车场(库)的所有人或者其委托的管理人应当按照市交通行政主管部门的要求,在满足自身停车需求的条件下,向公众开放。

在公共停车位不足的区域,应当采取措施鼓励专用停车场(库)向公众开放。

第六章 法律责任

第三十条 (行政处罚)

市、区(县)交通行政主管部门对违反本办法的行为,按照下列规定予以处罚:

(一)公共停车场(库)经营者、道路停车场管理者违反本办法第十五条第(一)、(二)、(三)、(四)、(六)项和第二十三条规定,可处以警告或者200元以上2000元以下的罚款;

(二)机动车驾驶员违反本办法第二十四条第一款规定的,应当责令改正,补缴停车费;对拒不缴纳停车费或者超时停车的,可处以警告或者50元以上300元以下的罚款;违反第二十四条第二款规定的,可处以警告或者20元以上50元以下的罚款;

(三)公共停车场(库)经营者、道路停车场管理者违反本办法第二十七条第三款规定,可处以警告或者1000元以上1万元以下的罚款;

(四)公共停车场(库)经营者、道路停车场管理者、专用停车场(库)所有人或者其委托的管理人违反本办法第二十八条规定,可处以警告或者300元以上3000元以下的罚款。

违反本办法有关规划、建设、价格、票据、道路、交通安全等管理规定的,由相关管理部门依法予以处理。

第三十一条 (委托行政处罚)

市、区(县)交通行政主管部门可以委托其所属的陆上运输管理机构实施本办法规定的行政处罚。

第三十二条 (妨碍公务的处理)

拒绝、阻碍行政执法人员执行公务,违反《中华人民共和国治安管理处罚条例》的,由公安部门依法处理;构成犯罪的,依法追究其刑事责任。

第三十三条 (对行政执法人员的要求)

行政执法人员应当秉公执法。对玩忽职守、滥用职权、徇私舞弊、索贿受贿、枉法执行者,构成犯罪的,依法追究其刑事责任;尚未构成犯罪的,给予行政处分。

第七章 附则

第三十四条 (临时停车场管理)

利用闲置空地开设经营性临时停车场,以及为为期30日以上重大活动临时开设经营性机动车辆停放点的,参照本办法有关规定执行。

第三十五条 (专用停车场的经营管理)

专用停车场(库)向公众提供经营性停车服务的,按照本办法有关公共停车场(库)的规定执行。

第三十六条 (有关用语的含义)

本办法有关用语的含义:

(一)公共停车场(库):指根据规划建造的以及公共建筑配套建造的经营性机动车停放场所;

(二)道路停车场:指在道路路内设置的机动车停放场所;

(三)专用停车场(库):指供本单位、本居住区机动车停放的场所和私人停车泊位。

第三十七条 (施行日期)

本办法自2005年3月1日起施行。1991年2月19日上海市人民政府发布,2001年1月9日上海市人民政府令第97号修正并重新发布的《上海市停车场(库)建设管理规定》同时废止。

Procedures of Shanghai Municipality on the Administration of Parking Lots (Garages)
Promulgated by Decree No.44 of the Shanghai Municipal People's Government on January 10, 2005)

Chapter I General Provisions

Article 1(Purpose and Basis)

For the purpose of strengthening the planning, construction and administration of parking lots (garages) in this Municipality, satisfying the parking needs, improving traffic conditions, and safeguarding the legitimate rights and interests of operators of parking lots (garages) as well as of parkers, these Procedures are formulated on the basis of the provisions of relevant laws and regulations.

Article 2(Application Scope)

These Procedures apply to the planning, construction and use of parking lots (garages) within this Municipality's administrative area and to the related management activities.

Parking lots (garages) mentioned in these Procedures refer to the public parking lots (garages), curb-side parking areas and special-purpose parking lots (garages).

Article 3(Administrative Departments)

The Shanghai Municipal Urban Traffic Administration (hereinafter referred to as the SMUTA) is the competent administrative department of this Municipality's parking lots (garages), responsible for organizing the implementation of these Procedures. The district (county) traffic competent administrative departments are responsible for the administration of the parking lots (garages) within their respective administrative areas according to their respective prescribed functions and duties.

The Shanghai Municipal Land Transportation Administration Division and the district (county) land transportation administration offices (hereinafter referred to as the land transportation administration agency) are responsible for the routine administration work of parking lots (garages) within their respective administrative areas according to their respective prescribed functions and duties.

The administrative departments of planning, construction, municipal works, public security traffic, housing, land and resources, finance and price control of this Municipality shall cooperate in enforcing these Procedures according to their respective functions and duties.

Article 4(Trade Association)

This Municipality's parking service trade association shall, according to the provisions of laws and regulations, give play to its trade self-disciplining role and may be entrusted by the SMUTA to cooperate in doing a good job of the management of public parking lots (garages) in this Municipality.

Article 5(Encouragement and Popularization)

This Municipality encourages the construction of public parking lots (garages) with multiple investments and the opening of special-purpose parking lots (garages) to the public, and popularizes the application of intelligence and information means in the management of public parking lots (garages) and curb-side parking areas.

Chapter II Planning and Construction Management of Parking Lots (Garages)

Article 6(Drawing up of Planning)

The specialized system planning of public parking lots (garages) shall be drawn up by the SMUTA jointly with the municipal public security traffic management department on the basis of the layout structure of urban planning and the situation of the traffic demand and be brought into the overall planning of the whole city after being comprehensively balanced by the municipal planning administrative department and, submitted to the Municipal People's Government for examination and approval.

The district (county) government, when drawing up the controlled detailed planning, shall link it with the specialized system planning of public parking lots (garages). The municipal planning administrative department, when examining and approving the controlled detailed planning, shall solicit opinions of the SMUTA.

Article 7(Control over Land Use)

The land used for parking lots (garages) set out in the specialized system planning of public parking lots (garages) falls into the category of land used for roads and squares, and shall not be diverted to other purpose without being adjusted according to legal procedure.

Article 8(Set-up Standards and Design Norms)

The design schemes of public parking lots (garages) and special-purpose parking lots (garages) shall comply with the set-up standards and design norms of parking lots (garages) provided by the State and this Municipality.

This Municipality's set-up standards and design norms of parking lots (garages) shall be drawn up by the SMUTA jointly with the municipal public security traffic management department and the municipal planning administrative department, and shall be implemented upon approval by the municipal construction administrative department.

Article 9(Construction of Auxiliary Facilities)

Newly built public buildings and residential quarters shall have parking lots (garages) constructed as auxiliary facilities according to the set-up standards and design norms of parking lots (garages) provided by the State and this Municipality.

The auxiliary facilities of parking lots (garages) shall be designed, constructed and delivered for use synchronously with the principal project.

Article 10(Make-up Construction)

The following public buildings that have no parking lots (garages) constructed as auxiliary facilities according to the set-up standards and design norms of parking lots (garages) provided by the State and this Municipality shall have them constructed retroactively during reconstruction or extension:

(1) Railway stations, passenger wharves, airports, inter-provincial-highway passenger stations and transfer hubs of public transit system and private-use vehicles;

(2) Stadiums, gymnasiums, cinemas, theaters, libraries, hospitals, convention and exhibition centers, scenic spots, business office buildings and office places undertaking external administrative affairs;

(3) Shopping malls, hotels, restaurants and entertainment establishments and other business premises with a ground area of over 5000 square meters.

Where the pubic buildings set out in the preceding clause can not have parking lots (garages) constructed retroactively under restriction of objective environmental conditions, the proprietors of the public building shall present a technical demonstration report of relevant experts to the municipal, district or county planning administrative department.

Article 11(Examination of Construction)

All relevant departments of this Municipality shall examine the construction of parking lots (garages) according to relevant provisions of this Municipality on the administration of examination and approval of construction projects.

The municipal, district and county planning administrative departments and construction administrative departments, when examining the planning schemes and preliminary design schemes of construction projects of public parking lots (garages), shall solicit opinions of the municipal, district and county traffic administrative departments and public security traffic management departments.

Article 12(Acceptance Check upon Completion)

The municipal, district (county) planning administrative departments, when conducting planning acceptance check of construction projects of public parking lots (garages), shall notify the municipal, district (county) traffic competent administrative departments to participate.

Chapter III Operation and Management of Public Parking Lots (Garages)

Article 13 (Operation Registering and Filing for the Record)

An operator of a public parking lot (garage) shall go through formalities of industrial and commercial and taxation registration according to law and, within 15 days after industrial and commercial registration, shall complete the-filing-for-the-record formalities by the presentation of relevant documents with the land transportation administration agency.

An operator of a public parking lot (garage) who alters his registration items or suspends business, shall go through relevant formalities as required with the industrial and commercial department and the taxation department, and shall, within 15 days from the date of alteration or business suspension, complete filing-for-the-record formalities with the land transportation administration agency, and make a public notice at the same time.

Article 14(Examination and Verification of Altered Use Nature)

No unit or individual person shall arbitrarily divert the already built public parking lot (garage) to some other purpose.

Where the use nature of a parking lot (garage) is altered, an approval by the municipal, district (county) planning administrative department jointly with the municipal, district (county) traffic competent administrative department and public security traffic management department shall be obtained.

Article 15(Parking Service Norms)

An operator of a public parking lot (garage) shall observe the following service norms:

(1)Putting up conspicuous, uniform signs of parking lot (garage) and parking rules drawn up by the SMUTA and making public the supervision telephone number;

(2) Drawing up management systems of parking, safety and security, and fire control;

(3) Installing complete illuminating equipment, communication equipment and parking meters;

(4) Commanding the incoming and outgoing and parking of vehicles in order, maintaining the parking order, and ensuring the normal operation of parking facilities;

(5) Executing the parking fee collection regulation, with charges clearly marked at the conspicuous place; and

(6) Working staff wearing an attendant tag.

Article 16(Drivers'Conduct Code)

Motor-vehicle drivers and the persons accompanying them, when parking at a public parking lot (garage), shall observe the following provisions:

(1) Obeying the working staff's command to park in order;

(2) No parking facilities or equipment shall be damaged; and

(3) No vehicles loaded with inflammable, explosive, poisonous, harmful or other dangerous cargo or other contraband goods shall be parked.

Chapter IV Management of Curb-side Parking Areas

Article 17(Set-up Principle and Scheme)

The set-up of curb-side parking areas shall be strictly put under total quantity control.

The set-up scheme shall be prepared by the municipal public security traffic administrative department jointly with the municipal public works administrative department and the SMUTA according to the following principles:

(1) Meeting the requirements of total quantity control over regional curb-side parking;

(2) Complying with the supply and demand situation of regional parking, traffic conditions and road bearing capacity; and

(3) Differentiating the parking demands in different time periods and for different uses.

Where an curb-side parking area is set up within 300 meters of service radius of a public parking lot (garage) located inside this Municipality's Outer Ring Road, the municipal public security traffic management department shall, jointly with the SMUTA, hold a hearing.

Article 18(Determination of Administrator)

The procedures for determining administrators of curb-side parking areas shall be separately formulated by the SMUTA.

Article 19(Charging Mode)

Charges for curb-side parking may be calculated at time or frequency rate.

Where charging at time rate is adopted for curb-side parking, the method of charging in progression or for time-limit parking may be adopted depending on road traffic conditions in peripheral areas.

Article 20(Charges Collecting Method)

Administrators of curb-side parking areas may collect parking fees by means of electronic meters or by manual type.

Article 21 (Management of Fees)

Curb-side parking fees belong to the category of the revenue of governmental departments and institutions and adopt the management of separation of revenue and expenditure. All revenues shall be turned over in full to the public finance, and expenditures shall be appropriated by the finance department according to the approved budget.

Article 22(Cancellation)

Where a curb-side parking area has any one of the following situation, the SMUTA shall, after seeking opinions of the municipal public security traffic management department, cancel it and notify the municipal public works administrative department timely thereof.

(1) The road traffic conditions have changed and curb-side parking has affected normal thoroughfare for vehicles; and

(2) Public parking lots (garages) in the periphery of the road have been able to meet the parking demand.

After cancellation of a curb-side parking area, the administrator of the curb-side parking area shall timely restore the original conditions of the road facilities.

Article 23(Service Norms of Curb-side Parking)

The administrator of a curb-side parking area shall observe the provisions under Article 15 Items (1), (5) and (6) of these Procedures as well as the following service norms:

(1) Marking out clear stall signs in the curb-side parking area and installing necessary illumination facilities;

(2) No arbitrary expansion of the road-occupied area; and

(3) In the case of adopting the method of charging by electronic meters, the operating instructions of electronic meter charging facilities shall be clearly displayed at a conspicuous place, and upkeep and maintenance of the facilities shall be strengthened to ensure the facilities are tidy and in good condition.

Article 24(Conduct Norm for Curb-side Parking)

A motor-vehicle driver who parks at a curb-side parking area shall observe the following provisions:

(1) Provision under Article 16 of these Procedures;

(2) Paying parking fees as provided; and

(3) No parking beyond the time limit at a curb-side parking area with a time-limit parking regulation.

A motor-vehicle driver who parks at a curb-side parking area adopting the electronic meter charging method shall put the payment evidence at a conspicuous position inside the front windscreen of the vehicle for check.

Chapter V Other Related Management

Article 25(Management of Rates)

In respect of service charges for this Municipality's parking lots (garages), market regulating prices, government guiding prices and government set prices are charged respectively according to different nature and type.

Parking lots (garages) carrying out government guiding prices and government set prices shall determine the parking fee rates according to different regions and different parking times and on the principle of charging more for curb-side parking than for outside-road parking in the same region.

Parking fee rates according to government guiding prices and government set prices shall be respectively set by the municipal price control competent administrative department jointly with the municipal finance department and the SMUTA.

Article 26(Management of Receipts)

The operator of a public parking lot (garage), when collecting parking fees, shall use uniform receipts made under supervision of the municipal local tax department.

The administrator of a curb-side parking area, when collecting parking fees, shall use special fee-collecting receipts made under supervision of the municipal finance department.

Where the operator of a public parking lot (garage) or the administrator of a curb-side parking area fails to issue a uniform receipt or fee-collecting receipt as required, the parkers may refuse to pay parking fees.

Article 27(Management by Information Technology)

This Municipality practices the public parking information system networking management.

The Shanghai land transportation administrative division shall organize the building of the public parking information system, spread the application of intelligence and information means in the management of public parking lots (garages) and curb-side parking areas, and take charge of the supervisory administration of the operation of the pubic parking information system.

Operators of public parking lots (garages) and administrators of curb-side parking areas shall, according to relevant provisions and norms, input their parking information in the citywide public parking information system.

Provisions and relevant norms on the networking management of the public parking information system shall be formulated by the SMUTA jointly with relevant departments.

Article 28(Statistics)

Operators of public parking lots (garages) and administrators of curb-side parking areas shall, according to the provisions, submit accurate statistical material to the land transportation administration agency.

The proprietor or his/her entrusted administrator of a special-purpose parking lot (garage) shall, according to the provisions, declare the number of stalls of the parking lot (garage).

The procedures on declaring the stall number of a special-purpose parking lot (garage) shall be separately formulated by the SMUTA jointly with the municipal housing, land and resources administrative department.

Article 29(Appropriation and Opening of Special-purpose Parking Lots)

During the holding of major activities in this Municipality, when public parking lots (garages) can not meet the parking demands of society, proprietors or their entrusted administrators of special-purpose parking lots (garages) shall, as required by the SMUTA, under conditions of satisfying the parking demands of their own, open their parking lots (garages) to the public.

In regions where there are not enough public parking stalls, measures shall be taken to encourage special-purpose parking lots (garages) to be accessible to the pubic.

Chapter VI Legal Liability

Article 30(Administrative Penalties)

The municipal, district (county) traffic competent administrative departments shall punish the violations of these Procedures according to the following provisions:

(1) The operator of a public parking lot (garage) or the administrator of a curb-side parking area who violates the provisions under Article 15, Items (1),(2),(3),(4),(6) and Article 23 of these Procedures is liable to a warning or a fine of between not less than 200 yuan and not more than 2000 yuan;

(2) A motor-vehicle driver who violates the provisions under Article 24, Clause 1 of these Procedures shall be ordered to make correction, and pay parking fees retroactively; a motor-vehicle driver who refuses to pay parking fees or who parks beyond the time limit is liable to a warning or a fine of between not less than 50 yuan and not more than 300 yuan; a person who violates the provisions under Article 24, Clause 2 is liable to a warning or a fine of between not less than 20 yuan and not more than 50 yuan.

(3) The operator of a public parking lot (garage) or the administrator of a curb-parking area who violates the provisions under Article 27 Clause 3 is liable to a warning or a fine of between not less than 1,000 yuan and not more than 10,000 yuan;

(4) The operator of a public parking lot (garage), the administrator of a curb-side parking area, or the proprietor or his/her entrusted administrator of a special-purpose parking lot (garage) who violates the provisions under Article 28 of these Procedures is liable to a warning or a fine of between not less than 300yuan and not more than 3,000 yuan.

A person who violates the provisions of these Procedures on the administration of planning, construction, price, receipt, road and traffic safety shall be dealt with by relevant departments according to law.

Article 31(Entrusted Imposition of Administrative Penalties)

The municipal, district (county) traffic competent administrative departments may entrust the land transportation administration agency under them to impose administrative penalties set out in these Procedures.

Article 32(Treatment of Obstruction)

A person who refuses or obstructs a law-enforcer in the performance of his or her official duties in violation of the"Regulations of People's Republic of China on Public Security Administration and Imposition of Punishment"shall be dealt with by the public security department according to law; if the wrongful act constitutes a crime, the wrongdoer shall be prosecuted for his or her criminal liability according to law.

Article 33(Requirement for Administrative law Enforcers)

Administrative law enforcers shall enforce law impartially. Those who neglect their duties, abuse their powers, engage in malpractice for personal gains, or extort or accept bribes, and bend the law when executing shall be prosecuted for their criminal liability according to law if the wrongful act constitutes a crime; and if the wrongful act has not gone far enough to constitute a crime, the wrongdoer shall be given disciplinary sanctions.

Chapter VII Supplementary Provisions

Article 34(Management of Temporary Parking Lots)

Operational temporary parking lots set up by utilizing idle land plots and operational motor-vehicle parking space set up temporarily for major activities lasting over 30 days shall follow relevant provisions of these Procedures.

Article 35(Operational Management of Special-purpose Parking Lots)

Special-purpose parking lots that offer operational parking services to the public shall follow the provisions of these Procedures governing public parking lots (garages).

Article 36(Definitions of Relevant Terms)

Definitions of relevant terms under these Procedures:

(1) Public parking lot (garage) means the operational motor-vehicle parking place built according to planning and built as auxiliary facilities of public buildings.

(2) Curb-side parking area means the motor-vehicle parking space set up inside a road.

(3) Special-purpose parking lot (garage) means the parking place of a unit and residential quarter for motor vehicles as well as private car stalls.

Article 37(Effective Date)

These Procedures shall become effective on March 1, 2005. The"Procedures of Shanghai Municipality on Construction Administration of Parking Lots (Garages)"promulgated on February 19, 1991 by the Shanghai Municipal People's Government, and revised and re-promulgated on January 9, 2001 by Decree No.97 of the Shanghai Municipal People's Government are repealed on the same date
