Article 1 In order to strengthen the security management of the activities of cultural recreation and sports, celebrations, and commodities fairs in the Shenzhen Special Economic Zone (hereinafter referred to as the Special Zone) and to guarantee the safety of the people‘s lives and property, these rules are hereby formulated according to Regulations of the People’s Republic of China on Punishments in Public Order and Security Administration and Regulations of the Guangdong Province on the Security Systems in Government Offices, Organizations, Enterprises, and Institutions.
Article 2 These rules shall apply to the activities of cultural recreation and sports, celebrations, and commodities fairs temporarily held in the public places of the Special Zone and open to the public.
Article 3 The activities of cultural recreation and sports referred to in these rules shall mean the grand activities of cultural recreation composed of theatrical performances, movies (including projections) and various other shows in a comprehensive way, and major sports games; but the regular shows and projections in the indoor cinemas and projection theaters which are approved shall not be included.
The activities of celebrations referred to in these rules shall mean the celebrations through which the governments at various levels, offices, organizations, enterprises, institutions express their joy at a rally in the legal national holidays, the city‘s holidays, or anniversaries.
The activities of commodities fairs referred to in these rules shall mean the activities of exhibition and display to introduce and sell various commodities which are conducted in the open places such as parks, vacation resorts, etc. by sponsoring units.
Article 4 When conducting the activities of cultural recreation and sports, celebrations, and commodities fairs, a security system of “whoever sponsors is responsible” shall be put into practice, no private contract shall be allowed for security.
Article 5 The departments of public security at the various levels of the Shenzhen Municipality shall be the responsible departments for the public security management of the activities of cultural recreation and sports, celebrations, and commodities fairs.
The various district bureaus of public security shall be responsible for the security management of the activities of cultural recreation and sports, celebrations, and commodities fairs conducted in their respective jurisdictions; the municipal bureau of public security shall be responsible for the activities of cultural recreation and sports, celebrations, and commodities fairs conducted in the trans-district places.
Article 6 When conducting the activities of cultural recreation and sports, celebrations, and commodities fairs, the sponsoring units shall be responsible for security; in case of renting a place, the sponsoring unit and the unit providing the place shall jointly responsible for security.
When conducting these activities jointly with a unit or individual out off the administrative jurisdiction of the People‘s Republic of China, the host unit shall be responsible for security.
Article 7 The sponsoring units of the mass activities of cultural recreation and sports, celebrations, and commodities fairs (including the host units in the activities concerning foreign nationals, the same below) shall work out the security plans according to these rules, file applications to the responsible departments of public security and obtain approvals. The main contents of a security plan shall include:
the categories of the conducted activities, the sponsoring unit, the unit to lease a place;
the name, post, address, and telephone number of the person in charge of security;
the specific contents, size, duration, place, hosting capacity of the activities;
the size, categories, specific location, estimated number of vehicles to be parked, firefighting measures of the parking place;
the distribution methods and the number of admission tickets, visit tickets;
the name list of the security personnel, the security requirements and emergency measures.
Article 8 Various sponsoring units shall work out their security plans in principle
according to the proportion of one security person per hundred of people to participate in the activities.
Article 9 If the activities of cultural recreation and sports, and celebrations are conducted in the name of the municipal government, the municipal bureau of public security shall be responsible for working out the security plans; if the activities of cultural recreation and sports, and celebrations are conducted in the name of a district people‘s government, the district sub-bureau of public security shall be responsible for working out the security plans and deploying the security forces.
Article 10 When a security plan has to be reported to the municipal bureau of public security for examination and approval, it shall be filed 15 days in advance; when a plan has to be reported to a district sub-bureau of public security for examination and approval, it shall be filed 10 days in advance.
After receiving an application, the responsible departments of public security shall promptly do on-the-spot security inspection and make a decision within 7 days (5 days for a district sub-bureau of public security) from the date of receiving the application.
If a security plan has failed to be approved, the corresponding activities of cultural recreation and sports, celebrations, and commodities fairs shall not be conducted.
Article 11 If a unit which has obtained an approval cannot conduct the activities at the planned time or in the planned place because of special circumstances taking place before the activities starts, it shall report the situation to the responsible department of public security 48 hours ahead of the original date of the activities so that effective measures shall be taken.
If a responsible department of public security has to deal with new special circumstances which make it impossible for the activities to take place according to the original plan, the department shall inform the sponsoring unit of the change of time and place 24 hours ahead of the time for the activities to take place.
Article 12 If one of the following situations applies to a unit sponsoring the activities of cultural recreation and sports, celebrations, and commodities fairs, a fine of less than 2,000 RMB shall be imposed, an administrative detention of less than 15 days may be imposed on the person in charge of the unit and the directly responsible persons according to Regulations of the People‘s Republic of China on Punishments in Public Order and Security Administration, if a crime has been constituted, the criminal responsibility shall be ascertained by the department of justice according to law:
failing to present a security plan to the responsible department of public security;
conducting the activities without authorization when the presented security plan has not been approved;
failing to earnestly carry out the security plan and refusing to make correction after receiving the notice.
Article 13 If the person in charge of a sponsoring unit and the directly responsible
persons have neglected their duties and caused an accident, the responsible department at a higher level shall impose disciplinary sanctions, if the circumstances are serous enough to constitute a crime, the criminal responsibility shall be ascertained by the department of justice according to law.
Article 14 The people who participate in the activities of cultural recreation and sports, celebrations, and commodities fairs shall listen to instruction and obey management, if there are criminal activities, the legal responsibility shall be ascertained according to law.
Article 15 If a party concerned has refused to accept the penalty imposed by a department of public security, an application for administrative review may be filed according to the related law and regulations, an administrative litigation may also be taken at the people‘s court according to law.
Article 16 These regulations shall take effect as of the date of promulgation.
